The difference between legislation and court order?

"On April 7th Vermont became the first state to allow gay marriage through legislation, rather than a court order".


Can anyone please tell me the difference b/w legislation and court order?|||legislation = law made by legislatures


Order = law made by a judge (or panel thereof)





The Order may or may not apply to you, it depends on if the decision was published or if you were a party to the action.|||Legislation is an act of the legislature - The State House (or whatever their equivalent is).





A Court Order is an act of the judiciary - A Judge on a bench makes a ruling.

Why is the current congress stonewalling legislation to allow more domestic oil production?

Nancy Pelosi won't let legislation come up for a vote that would allow us to produce more oil and help lower the price of gasoline. Why won't she and the democrats let it come up for a vote?|||because the current congress wants to blame the lack of action on a republican president and not having enough of a majority ..

The problem is that most people do not understand supply and demand economics and what the structure is of the cost of gas per gallon. Do you know that we are using more oil now than EVER before! People are driving at an alarming rate. Do you realize how much petroleum鈥檚 used in making plastics and then how many things we use are made of plastics? The oil company makes about 12 cents a gallon as profit. The rest is made up of Federal and State taxes, the cost of exploration and the cost of production, Refining and then the cost of the additives that we have to put in the gas (we call it designer gas, thanks to the environmentalist wacko's). Do you know that we have not built a refinery in almost 60 years? (thanks again environmentalist). The refineries that we have are working at capacity and that is not enough to keep up with demand. Do you know that we hardly get any oil from the Middle East? Yes we are not in Iraq for oil, they have enough to export but not as much as you think. Even iran imports most of their oil. Most people think that is where it all comes from. Not true. We get our oil form Canada, Mexico, Venezuela and Africa, in that order. What we get from Saudi is a very small %. You want the cost of gas to drop....STOP driving or at the very least cut back 10% and you'll see gas prices drop. In addition to that we need to open up the ANWR for drilling and off our coasts and the Gulf, as well as exploit the new found pools in the Wyoming Range (thanks again environmentalist) OR come up with an alternate fuel. Even if you had a viable economic alternative fuel source, the production and the distribution of it is decades away. Wake up people, cut back!|||1. 81% of Americans want to do it. Regardless of party affiliation.





2. Because it will lower the cost of gas.





3. Because it would help the popor and middle class.

On WETM, in November of this year I heard about a proposed legislation that would make senior citizens with less than 40.000 a year be totally exempt from paying property taxes.|||You said it yourself..it is a PROPOSED bill.





Even if it did happen, by the time it is said and done the House will have had to raise taxes elsewhere to cover this tax exemption and that means ticking off "someone" else who will ultimately say "no we don't want OUR taxes raised".

I think people would care more about what was being passed if they were more directly impacted by the cost of the legislation. Right now, expensive legislation is passed and people don't really feel the impact of the cost, so it doesn't really matter to them. But our children and grandchildren will feel the impact for sure.

All birth certificates in the US are based on the US Standard Certificate of Live Birth from the CDC. Even BCs in 1961 said they were Certificates of Live Birth. It matches the State Department guidelines for a passport, the I9 requirements for proof of citizenship, the Little League requirements, and the DMV requirements in every state. It is a valid and legal certified birth certificate.





If the AZ bill passes, the AZ Sec of State says he will accept Obama's COLB. But the bill is unconstitutional and would be thrown out as soon as it hit a judge's desk. States can't put additional restrictions on Constitutional offices than appear in the Constitution, and states must accept the official documents of other states. So if Hawaii says the COLB is a legal birth certificate, and certifies that Obama was born in the state of Hawaii, AZ and every other state must honor that certification.





BTW -- Arizona hasn't collected doctor's and witnesses' signatures on their birth certificates since 1989. In 14 years, no one born in AZ after 1989 will be eligible for the AZ ballot.|||He'll probably try to win without the support from Arizona. Truthfully, I'm not an Obama fan and am not just doubting his eligibility because he's black or democratic...but I do have some legitimate doubt and would like him to step up and show his real birth certificate. Thanks in advance :)|||Delegated legislation (aka subsidiary legislation or secondary legislation) is legislation not made by parliament but under the authority of parliament.





There are 3 main types of delegated legislation, Bye-Laws, Statutory Instruments (SI's) and orders in council, an act of parliament usually known as the Parent or ENABLING act such as the Health and Safety at Work Act 1974. It lays down the framework for the law relating to the parent act.





Basically the Parent Act (aka Enabling) sets out the powers for more law to be made through the use of that act.





BYE LAWS:


Bye Laws are local laws which tend to be limited to a particular area, most bylaws are made by local authorities but other public and private bodies can eg. Military, Airport, Rail.





Bye laws are drawn up by relevant body and then approved by govt. minster responsible for that area of law such as the minister responsible for Local Govt.





The local govt. act 1972 gives local authorities the power to make bye laws to control nuisances, Section 235 gives power to make bye laws for "the good rule of govt. of the whole or part of the district or borough...and for the prevention and suppression of nuisances therein"





This might cover things like littering, parking, ball games, dog fouling, horse riding, or even skateboarding or playing music. Smoking on a train is a bye law as is trespassing on railway property and trespassing on military land (Parents Act: Military Lands act 1892)





SI's:


This is the most common form of delegated legislation, each SI contains large number of regulations and they are drawn up by govt. minsters under powers delegated by parliament, they are used to fill out the detail of the law when parliament does not have the time or expertise to do so, this is so it can be updated later on and changed on a regular basis, examples include environmental laws, planning laws and employment laws. 3500 SI's were passed in 2007.





The Road Traffic Act 1972 included requirement for a helmet to be worn on a bike but left it to Secretary of State to draw up detailed regulations as to the type of helmet. This was included in the Motor cycles (protective helmets) Regulations 1980 (an SI).





ORDERS IN COUNCIL:


Orders in Council are made by the privy council which was once the group of minsters who acted as chief advisers to the monarch, it is now made of past and present senior ministers and they make law, orders in council can be made to transfer powers between govt. depts or made make emergency laws in time of national crisis or when law needs to be passed quickly or if parliament is not sitting.





This parent act for this was The Emergency Powers Act 1920 and examples of its use include the foot and mouth crisis and the energy act 1976 (Reserve powers order 2000).





I shortened it as much as I could, hope it helps. Hope uni goes well, thinking of taking business there myself in a year. I missed some bits out but that's the main stuff.
